|Qualified Period||May 1, 2013 – December 31, 2021|
|Eligible Customers||All persons residing in the United States who purchased the NuWave Standard Dome or Power Dome (“Dome”) and/or any a NuWave Oven Pro, NuWave Oven Pro Plus or NuWave Oven Elite (“Oven”), for personal, family or household purposes, and not for resale, directly from NuWave or a NuWave authorized retailer during the Qualified Period that has suffered a Dome Failure.|
|Original Dome||One Oven or Dome that an Eligible Customer purchased during the Qualified Period (whether as an individual Dome or with an Oven)|
|Dome Failure||A Dome shall be deemed to have suffered a “Dome Failure” if it (a) melts or warps in a way that renders the Dome unusable for its intended purpose, or (b) suffers a crack or breakage that penetrates through the entire depth of the Dome’s plastic.|
|Special Warranty Period||
NuWave shall provide a first replacement Power Dome (“First Dome”) free of charge to all Eligible Customers who make a claim that meets the Claim Requirements during their Special Warranty Period. Each Eligible Customer will be eligible for a maximum of one First Dome. If an Eligible Customer’s First Dome suffers a Dome Failure during the Special Warranty Period, NuWave will provide a second replacement Power Dome (“Second Dome”) free of charge if the customer meets the Claim Requirements.
The Special Warranty provides Eligible Customers with right to claim a maximum of two replacement Power Domes during the Special Warranty Period. Dome. An Eligible Customer’s purchase of more than one Oven or Dome during the Qualified Period does not entitle the Eligible Customer to more than two replacement Power Domes under the Special Warranty.
NuWave shall make its initial decision on a Special Warranty claim within 14 days of receiving a First Dome or Second Dome claim. For honored Special Warranty claims, NuWave will ship the replacement First Dome or Second Dome to the customer free of shipping and handling charges within 14 days after making its initial decision. If NuWave requires the failed Dome be shipped back to NuWave to evaluate a Second Dome claim, NuWave will arrange for the shipping of the First Dome to NuWave at NuWave’s expense within 21 days of receiving the claim, make its warranty decision within 14 days of receiving the First Dome, and thereafter ship the replacement Second Dome free of shipping and handling charges within 14 days of honoring the claim.
Notification of First Dome or Second Dome denial shall be given by responsive email for emailed claims and by mail for mailed claims.
An Eligible Customer’s receipt of a replacement Dome under NuWave’s standard warranty shall not affect the Eligible Customer’s rights under the Special Warranty.
To claim a First Dome, the Eligible Customer must attest under penalty of perjury that (a) they meet the definition of an Eligible Customer and (b) that their Original Dome has suffered a Dome Failure. Eligible Customers claiming a First Dome have the option, but are not required, to submit photographic proof of Dome failure.
To claim a Second Dome, Eligible Customers must (a) attest under penalty of perjury that they meet the definition of an Eligible Customer, (b) attest that the First Dome suffered a Dome Failure, and (c) provide photographic proof of the Dome Failure of the First Dome. If in NuWave’s judgment the Eligible Customer has not made a showing that the First Dome has suffered a Dome Failure with the submitted photograph, NuWave may require the customer to ship the First Dome to NuWave at NuWave’s expense.
